Mudanças de salários de parlamentares: vigência apenas na legislatura seguinte

A última das emendas constitucionais americanas, a de n. 27, prevê que toda e qualquer alteração na remuneração dos congressistas americanos só começa a valer na legislatura seguinte. Seria muito interessante implantar uma regra como essa no Brasil. Nos EUA, a emenda deveria ser uma das emendas constitucionais primevas, que formam o bill of rights. Entretanto, apesar de ter sido submetida, pelo presidente James Madison, à apreciação do Congresso em 25 de setembro de 1789, na primeira legislatura da história do Congresso americano, ela só foi aprovada por todos os estados-membros dos EUA em 1992.

Note-se que aquela que era para ser uma das emendas iniciais do bill of rights (das 12 apresentadas por Madison apenas 10 foram aprovadas na ocasião; a de que trata este texto foi aprovada em 1992; e uma última ainda não foi aprovada e está "pendente").

Penso que a regra da emenda de n. 27 da Constitução americana é verdadeira garantia ao cidadão e ao erário. A limitação que se impõe à elevação de salários parlamentares pelos próprios parlamentares visa a coibir abusos e casuísmos. Seu caráter procedimental fomenta o planejamento e a impessoalidade, à medida que os parlamentares de uma dada legislatura nunca serão capazes de alterar seus próprios salários (ao menos durante o mesmo mandato), mas apenas o de seus sucessores. Ademais, o fator tempo favorece o amadurecimento de propostas e desfavorece decisões precipitadas.

Iniciativa popular na Alemanha

É absurdo que, no Brasil, após o preenchimento dos cansativos e exigentes requisitos que condicionam a submissão de lei de iniciativa popular, possa o Congresso emendar, livremente, um texto acerca do qual há ampla concordância popular.

Deveria ser lícito ao Congresso dizer apenas "sim" ou "não". Ou, na hipótese de ter o Parlamento modificado a lei de iniciativa popular, dever-se-ia submeter o novo texto, com as modificações introduzidas, ao crivo de um referendo. Dessa forma, por meio de apreciação popular, obsta-se que o Congresso possa desnaturar o projeto apresentado, como já ocorreu anteriormente no Brasil.

As Constituições dos estados (Bundesländer) da Bavária (Bayern) e de Baden-Würtemberg preveem procedimentos como esse, que limitam a discricionariedade do parlamentar quando da aprovação de projetos de lei apresentados mediante iniciativa popular.
